Employees in regular or term appointment positions accrue 21 working days of annual leave per fiscal year, prorated based on FTE.

• Leave accrued in excess of 240 hours at the close of business on June 30 of each year shall be forfeited.
• Non-regular term appointment employees will forfeit all unused accrued leave on July 1 and upon termination of their term appointment.  No payout of unused annual leave will be made upon termination of employment.

NM ERB Retirees

NM Educational Retirement Board (ERB) retirees who are reemployed in regular or non-regular term appointment positions will accrue annual leave under the same rules as regular employees, prorated based on FTE. However:

• All earned annual leave must be used or forfeited by June 30 of each fiscal year.
• No payout of unused annual leave will be made upon termination of employment.
